These Terms and Conditions govern your use of the event promotion and e-learning website located at funkymambo.co.uk, which is hosted by London City Dancers LTD, the "Platform", on behalf of Funky Mambo, the "Organizer". By using this website, you agree to these Terms.
1. The Platform's Role
The Platform provides technical and administrative services that enable Organizers to promote events, sell tickets, and distribute e-learning materials online. The Platform does not control the Organizer's events or operations.
In order to protect against fraud, centralize transaction processing to minimize fees, and to enable additional marketing opportunities, the Platform operates in one of two capacities. The specific capacity in which your transaction is processed will be indicated to you during the checkout process:
As a Payment Collection Agent: For some transactions, the Platform acts strictly as a limited payment collection agent for the Organizer. The contract for attendance or purchase is strictly between you and the Organizer. In these cases, payment to the Platform shall be considered the same as payment made directly to the Organizer.
As the Merchant of Record: For other transactions, the Platform will act as a primary seller or reseller. In these instances, your purchase contract is with the Platform, though the Organizer remains entirely responsible for the delivery of the physical event or content.
2. Fees and Payments
Ticket prices, digital content pricing, availability, and event-specific policies are determined by the Organizer. A Service Fee (as disclosed at checkout) may be applied to cover platform administration, payment processing, and related services.
By completing your purchase, you authorize the applicable merchant to process your payment.
3. Tickets and Refunds
All ticket purchases are final unless otherwise stated by the Organizer. The Organizer is solely responsible for setting the refund, cancellation, or exchange policies for their events and content.
Where you purchase directly from the Organizer (Agent model), the Organizer is solely responsible for administering and issuing your refund.
Where the Platform acts as the Merchant of Record, we will process refunds strictly in accordance with the Organizer's stated policy.
The Platform does not independently grant refunds contrary to an Organizer's policy except as required by law. Where refunds are issued, service fees may be non-refundable except where legally required.
4. Event Entry and Conduct
The Organizer retains full control over event entry and conduct. The Organizer may refuse admission or remove any attendee who violates event rules, venue policies, or applicable laws. Such decisions are made solely by the Organizer and its staff.
5. Liability and Risk
Regardless of whether your transaction was processed by the Platform or directly by the Organizer, the Organizer is solely responsible for planning, hosting, and operating the physical event, including attendee safety, venue suitability, and compliance with applicable laws. The Platform does not control or supervise events and disclaims all responsibility for their execution.
Neither the Organizer nor the Platform is responsible for personal property that is lost, stolen, or damaged at an event. By attending a social dance event, you acknowledge the physical nature of dancing and voluntarily assume all inherent risks.
To the maximum extent permitted by law, the Platform shall not be liable for indirect, incidental, or consequential damages arising out of your use of the Platform or attendance at any event.
6. Media
By attending an event, you acknowledge that the Organizer may photograph or record the event for promotional or archival purposes. Any such media is owned and controlled by the Organizer and used in accordance with its policies.
7. Data Protection and Communications
For the purposes of applicable data protection laws, personal data means any information relating to an identified or identifiable individual.
Controller and Processor Roles: The Organizer acts as the Data Controller for attendee personal data processed for event management, communications, learning content curation, and marketing of the Organizer's events and content. The Platform acts as a Data Processor for certain processing activities carried out on behalf of the Organizer.
Separately, the Platform acts as an independent Data Controller for personal data processed for the following platform purposes:
- Creating, managing, and deleting user accounts
- Website user authentication and authorization
- Facilitating payment processing and maintaining transaction/accounting records (whether acting as an Agent or Merchant of Record)
- Fraud prevention, abuse detection, and platform security
- Internal analytics and service improvement
- Promotional activities
- Compliance with legal and regulatory obligations
Organizer Communications
The Organizer may contact you regarding the event you purchased tickets for and, where permitted by applicable law, about future events. You may opt out of non-essential marketing communications at the time of purchase or via unsubscribe links included in Organizer communications.
Platform Communications
The Platform may send you transactional or service-related communications (such as ticket confirmations, account notices, or security alerts) that are necessary to perform its services and, where permitted by applicable law, marketing communications. You may opt out of non-essential marketing communications at the time of purchase or via unsubscribe links included in Platform communications.
User Accounts
Making a purchase may require the creation of a user account. Account creation and management are necessary for the performance of this contract. You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.
The Platform processes personal data where necessary for the performance of this contract, compliance with legal obligations, or its legitimate interests in operating and securing the Platform.
8. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and Conditions or their subject matter.
